decided.
A federal appeals court agreed that Gov. Rod Blagojevich could not seize $125 million from an environmental trust fund to help ease a state budget deficit.
The Blagojevich administration had appealed after a federal judge ruled in April that the state would be violating federal law by taking private property for public use without just compensation.
The 7th U.S. Circuit Court of Appeals affirmed that ruling Wednesday.
The Illinois Clean Energy Community Trust Fund was authorized as part of the 1999 deregulation of the state's electric industry. Power company Commonwealth Edison donated $225 million for grants to improve energy efficiency in libraries and schools.
The foundation was established as an independent charity, though five of the six trustees are appointed by state officials. That court added in its ruling Wednesday that just because the majority of the board is state-appointed doesn't make the foundation a state agency.
Yes, you read it correctly, the State established a private charity for a specific purpose, and Blago decided he wanted to loot the donations for his own uses.
Was this not so blatantly wrong that Governor Super-Genius should've known that an appeal would be pointless? Meanwhile, our ongoing crisis

Agencies that give seniors a lift to doctor's appointments or grocery stores are the latest victims of the state's budget problems.
The state had promised the agencies funding to replace aging vans and mini-buses. But lawmakers haven't designated the money yet, and it's unclear when and if they will.
Governor Blagojevich has asked the Transportation Department to pay for 44 vehicles in the Chicago area and two downstate. But a few hundred more are on hold, and a transportation official says the state agency is looking for ways to fund them.
